Abstract:
It is proposed to re- read the legal and
literary sources, with the aim of realizing
a new and renewed reflection on the legal
qualification of the sea. In particular, it
deals with the concept of the sea in ancient authors, considering some literary
sources, sometimes neglected by the doctrine or just cited, and then propose the
reconstruction of the lines of jurisprudential interpretation of the sea in Roman
law by examining the testimonies of the
Roman Jurists from Labeone and Aristone
to get to Ulpiano and Marciano. Following
a chronological course, it is framing the
jurists’ attestations, for the contents of
the texts considered, in the field of the ius
civile, ius gentium and ius naturale.
