Il profilo « relazionale » dell'organo della persona internazionale e i suoi riflessi sulla formazione della volontà dello Stato

Can a State as subject of international law « will » and « speak » through the will and voice of a single individual, if that individual is at the top of the State government? The answer to such a question is less simple than it might seem. This article aims to evaluate the driving role played by the expressions of will of certain individuals/organs in the gradual formation of the will of the State regarding potential future actions of the international person. This phenomenon may be influenced by the « relational » nature of the international person’s organ: the notion of organs of the international subject cannot rely only on its definition from the internal point of view of the State, but must also take into account the external perspective of the other international subjects with which certain individual organs interact.
