abstract:
This contribution analyzes the art. 141-bis of the Cultural Heritage and Landscape Code (Legislative Decree 22 January 2004, n. 42 and subsequent amendments), and aims to reflect, in specific terms, on the problem relating to assessments of protection of landscape constraints adopted by the competent administrative bodies (and their possible updating). The code discipline on the subject of landscape makes the identification of usage requirements for each landscape asset dutiful and obligatory.
