abstract:
The essay illustrates the theme of responsibility theorised by Michel Villey in two studies: the first, published in 1969, is devoted to criminal responsibility in the thought of St Thomas, the second, from 1977, to the Romanist roots of aquilian responsibility. It is in the second essay, in particular, that Villey illustrates his concept of responsibility, derived from Roman law, aimed at guaranteeing social equilibrium, rather than the prerogatives of the individual as will be the case in the modern age. All the elements of Villey's philosophy of natural law are declined in the thesis of a responsibility to be rediscovered, once the interferences of modern doctrine of natural law have been eliminated, and restored to contemporary legal experience, called upon to provide answers of justice that the individualist and formalist theory of law is unable to provide.
