abstract:
The article proposes to analyze the work carried out by the expert appointed
by the court in the context of disputes relating to banking relations, such
as, for example, the hypothesis in which the client complains of the unlawful
application of compound interest or the entry of debit items for expenses or
commissions in breach of mandatory rules. In particular, the work carried out
by the technical adviser in such cases is also a suitable means of reconstructing
the thema probandum in relation to the creditor’s claims, which will be
exercised in court
