The paper deals with the issue of the right to be forgotten in the criminal justice system, focusing on the right to non-indexing and de-indexing as provided by the Legislative Decree No. 150 of 10th October 2022, in favour of individuals involved in criminal proceedings who have subsequently received a favourable ruling. The analysis also examines the relationship between media coverage and the presumption of innocence, as well as the application of the right to be forgotten concerning convicted individuals and those not formally involved in criminal proceedings.
