The article places the contract at the centre of a dialectical relationship between private autonomy and the legal system, that is, between two poles, each of which is characterised by specific needs and purposes. This dialectic evolves historically due to the mutation of socioeconomic, geopolitical and cultural factors. The jurist must be aware of it to best carry out his mission.
