The judgment of the Cagliari court dealt with the conflict between two assignees
of the same share in a publicly-owned company, focusing on some interesting aspects
of the regulations set forth by the “Testo unico in materia di società a partecipazione
pubblica” (TUSPP). In particular, the Judges provided insightful indications
regarding the sanction resulting from the public shareholder’s inaction in carrying
out the special review of his shareholdings, the prerequisites, and the legitimacy to
activate the special liquidation mechanism provided for in article 24 of the TUSPP
and to participate in the related assignment deed.
