L'intrasmissibilità del rapporto giuridico nel pensiero di Mario Allara

The paper summarizes Mario Allara’s thought on the limits to the transmissibility of legal relations, centred on the relevance of the connection between structure of the norms (i.e. the state of affairs described thereunder) and relevant legal effects. As a result, such limits appear to be significantly reduced in their application, covering only use rights (diritti di uso), housing rights (diritti di abitazione) and maintenance claims (crediti alimentari). However, through the analysis of different legal relations, not addressed by the Author, the paper tries to clarify analogies and differences between the cases under exam and the rules applicable to them.
