La responsabilità dell’armatore e la sua limitazione

The paper examines the issue of liability in the shipping industry and the
identification of the liable party. It considers, in particular, the history of the establishment
of limitation systems, the legal nature of them (limitation of the debt or limitation of
the liability) and the reasons for their adoption. Examining the current Italian legal
framework, the author suggests that Italy will finally accede to the LLMC system. He
also wonders whether a homogeneous regime of limitation for ships up to 300 tons
should not be preferable
