La procedura penale messa alla prova. Quale spazio per la giustizia riparativa?

The probation has been revised and strengthened with the recent procedural reform, also through the enhance-
ment of the restorative justice perspective. The intersection of these two different hypotheses of early definition

of the ordinary procedure makes some reflections necessary relating, first of all, to the impact of similar devia-
tions on the fundamental rights and, furthermore, to the concrete realization of an objective that is not a simple

statistical increase of the use of procedural deflation, but rather a use of restorative justice as a real tool aimed to
defusing social conflict.
