La causa del contratto: una questione culturale

Abstract italiano: Il saggio muove da alcune vicende giurisprudenziali recenti, nelle quali il giudice è stato chiamato a confrontare schemi contrattuali “alieni” con le regole ed i principi dell’ordinamento statuale; inevitabile è stato quindi il richiamo al concetto di causa, quale criterio di valutazione dell’operazione contrattuale divisata dalle parti. Da qui la riflessione intercetta il pensiero di Renato Scognamiglio e la sua visione dell’autonomia privata come dato fenomenico che dialetticamente interagisce con il sistema normativo, ora arricchito nella sua dimensione costituzionale ed europea.
Abstract inglese: The essay moves from some recent case-law decisions, where the judge has been called to scrutinize certain “foreign” transactions in the light of the rules and the principles of the Italian legal system; in this respect, the judge has used the notion of “causa” as criterion to evaluate the framework of interests pursued by the parties. Starting from this point, the study retraces the thought of Renato Scognamiglio and his vision of the private autonomy as factual phenomenon which dialectically interacts with the legal system.
