Il “portale del processo penale telematico”: un passo in avanti (e qualche inciampo) verso la digitalizzazione

The emergency linked to the spread of the Covid-19 virus has given a significant acceleration to the now unavoidable path towards the digitization of criminal procedural documents and, more generally, towards the start of the electronic criminal trial. If on the one hand the pursued objective appears worthy of appreciation, by virtue of the simplification that digitization entails, on the other hand the regulatory solutions developed for this purpose and the tools actually used have resulted, at least in the first phase, sometimes contradictory or inadequate. For an unexpected heterogenesis of ends,
therefore, the first steps towards digital simplification have generated uncertainties and confused application solutions, not entirely resolved by the innovations introduced by the Legislative Decree 1 April 2021, n. 44, converted with amendments by Law May 28, 2021, n. 76. The application of new technologies to the criminal process and, in particular, the electronic evolution of the forms of filing and notification of documents, appears in any case to be a priority to be supported in the perspective of contributing to the reform of criminal justice.
