Note in tema di pianificazione idrografica e contratti di fiume

This essay aims to provide a contribution to the legal framework of the river contract also highlighting the experiences developed in the practice. Although introduced a few years ago in the environment code, the river contract has not had much doctrinal elaboration remaining under the radar. In spite of its nomen juris, the river contract appears to be a legal operation in wich public powers and powers of private autonomy are brought together. It is characterised by a cognitive decision-making and operational process that due to its potential characteristics of elasticity, flexibility and adaptability to the physical environmental and institutional context, also plays a role of rescaling distribution operating in a dual direction: bottom up and horizontal.
