abstract:
The author analyses Antonio Scialoja’s concept of «living law», derived from the work of Eugen Ehrlich. Scialoja uses phrase «living law» with different meanings, referring to different theses. «Living law» occurs in his works: (i) to describe what we usually termed «law in action» and to define what law is (ontological thesis); (ii) to explain the general nature of legal interpretation (methodological thesis) and the nature of customary law.
