Il danno da perdita di chance: vera gloria o escamotage dialettico?

The article retraces the path followed by the case law concerning the liability for loss of chance, which has been conceived within labor law and medical tort and has been then developed towards other sectors of the tort law. This development has been brought until the recognition of an autonomous asset, corresponding to the chance which has been lost by the claimant.
This achievement may cause several questions, both theoretical and practical, especially in the light of an uncontrolled expansion of the damages. On the contrary, one sector where the concept of chance appears founded and justified is the tort law concerning the damages caused by public entities acting iure auctoritatis.
