Restitution shall be considered as the most appropriate remedy for non-economic damages arising from the violation of constitutional rights. However, the restitution gives rise to several problems, concerning the existence of a judicial discretion and the possibility of providing for atypical compensation measures. There are few judgments on this subject, but one of the most recent measures is a recent ruling by the Criminal Court of Rome, concerning a well-known case of child prostitution, which is characterized by the extreme originality of the compensatory measure.
