This paper deals with the judgment of the Constitutional Court No. 1 of 2021, which excluded the constitutional illegitimacy of automatic admission to legal aid for victims of the crimes listed in art. 76 paragraph 4-ter d.P.R. No. 115 of 2002, regardless of the income limits provided for by the decree mentioned above. The decision analysis offers an opportunity to reflect on the evolution of legal aid and vulnerable crime victims’ protection.
