Italy is a country with a high hydrogeological risk. According to data sup plied by the Directorate-General for Territorial Protection, about 6,663 Italian
municipalities are potentially in danger. The increasing occurrence of cata strophic events raises several legal issues: compensation for flood damage; the
insurance profiles of natural risks; exclusion of contractual and non-contractual
liability. Regions, provinces and municipalities can be considered responsible
according to art. 2051 of the Civil Code, in cases where flooding of water
courses is caused by poor river maintenance. In this case, the prevailing juris prudence considers that exceptional rain cannot be an accidental case.
