The article is focused on the punitive damages, moving from the Anglo-American tradition, and analyses their implementation within the Italian legal system, also taking into account certain recent indications offered by the European law. The crucial issue to cope with is the difference between the size of the prejudice and the size of the enrichment obtained through the tort, as well as in the attribution of this difference, whether to the person causing the prejudice or to the person suffering it.
