Articles from 32 to 51-novies of the code of tourism incorporate the new rules on package travel and linked travel arrangements introduced by Legislative Decree no. 62/2018 which implements directive (EU) 2015/2302. The national legislator remained faithful to the literal wording of the European Union regulation, without however renouncing to adapt the new regime to the fundamental principles of domestic law and without prejudice for the further rights already provided by the code of tourism for the protection of the travelers. The critical analysis of the most important legislative novelties in the package travel contracts is concluded with some reflections on the need to ensure an even balance of the parties’ interests and to guarantee to the players of such system the possibility to operate in conditions of equal competitiveness.
