The essay takes its starting point from Paolo Barile's book, Diritti dell’uomo e libertà fondamentali, which proposes an interpretation of the liberties in the constitutional law. The Author investigates its presupposed conception of the constitution and its consequences in the theory of constitutional interpretation, as well as its compatibility with positive constitutional law.
