L'intrasmissibilità del rapporto giuridico: attualità e rilevanza di un'opzione dogmatica

This paper summarizes the reflections on the intrasmissibility of the legal relation, moving from the analysis of legal norms that provide for the non-transferability of a right and, more generally, of the entire relation. As a result, such legal concept appears to be significantly reduced in his application, referring exclusively to right of use (diritto d’uso), right of habitation (diritto di abitazione) and maintenance claims (crediti alimentari). However, the dogmatic reflection proposed by the scholars allows delineating the boundary between the various examined cases and identifying the rules applicable to them.
