Can we still consider smart-contracts and self-enforcing contracts as real contracts? Starting from this question, the essay analysis the relationship in contempo-rary society between new digital technologies and the law. The purpose is to show that the only way to avoid the law being replaced by the new digital technologies, until its eventual disappearance, is by overcoming the concept that the sole function of the law is to regulate our future behaviour
