Che cosa significa conoscere il diritto?

Is the “knowledge” of the law possible? And, if it eventually were, in what would it consist of? This essay, moving from a reinterpretation of Hans Kelsen’s position, attempts at showing how the knowledge of law, that pertains to judicial science, has nothing to do with the task of “describing” the existing legislation, nor with the activities of interpretation and application of the instructions that courts and doctrine daily carry out. On the contrary, it consists of that objective function through which judicial science determines the regulations, what it is given inasmuch it is established by authority, as rules, that is as must-be relationships (Sollen). In this sense, the knowledge of law is, as I will try to show, a transcendental knowledge.
