Ostatività e benefici penitenziari: una riforma in itinere

The prohibition of access to penitentiary benefits for convicts of specific crimes, unless they usefully cooperate with judicial authorities, has been the subject of tormented events. The author analyzes the salient features of this system, focusing on the Italian Constitutional Court and the European Court of Human Rights case-law, as well as on a recent legislative proposal on the matter.
